These terms cover how gemma.studio works with you. gemma.studio is a business name of Stacie Dauffenbach Marketing Solutions LLC, based in Denver, Colorado ("we," "us"). By signing up for a plan or using this website, you agree to these terms. If you have a signed agreement with us, that agreement comes first where the two differ.
What we do
We research your business, send you a short questionnaire, write your questions, hold a monthly video chat with you and turn the best moments into short-form videos. The number of videos and the length of your chat depend on your plan. We deliver finished videos. We don't post, schedule or manage your social accounts.
Billing
• When you sign up, you pay the one-time setup fee and your first month together.
• After that, each month is billed in advance, before your chat. You can also pay for several months in advance.
• Launch pricing gives you 25% off your first three months. After that, your plan moves to the regular price shown on our site at the time you signed up.
• The setup fee covers research and prep work and isn't refundable. Monthly payments aren't refundable once that month's chat has happened.
Canceling
Plans are month-to-month with no contract. Cancel anytime by emailing stacie@gemma.studio before your next billing date and you won't be charged again. If you've paid in advance, we'll complete the months you've paid for.
Your chat
We'll schedule your chat with you each month. If you need to move it, just let us know ahead of time and we'll find a new time within the same month. A chat that's missed and not rescheduled that month doesn't carry over.
Changes to your videos
Each video includes one round of changes. Tell us what's off and we'll make the update. Additional changes beyond that round may be quoted separately.
Who owns the videos
• Once you've paid for them, the finished videos are yours to use to promote your business, on any channel you like.
• We keep the raw chat recordings and our own methods, templates and working files.
• Under launch pricing, and anywhere else you've agreed to it, we may show your videos as examples of our work on our website and channels. If you'd rather we stop, email us and we'll remove them going forward.
Your part
You're responsible for what you say in your chats and for how you use your videos. Please make sure your statements are accurate and follow the rules for your industry, especially if you're in a licensed profession like healthcare or law. You also confirm you have the right to share anything you give us, like logos or photos.
Limits of our responsibility
We work hard to make videos that help your business, but we can't promise specific results like views, followers, leads or sales. To the extent the law allows, our total responsibility for any claim related to our services is limited to the amount you paid us in the three months before the claim.
Changes to these terms
We may update these terms from time to time. We'll post the new version here and change the date at the top. If a change affects your plan or pricing, we'll let you know before it applies to you.
Governing law
These terms are governed by the laws of the State of Colorado.
